Family Sponsorship Eligibility: Everything You Must Know

Spouse or Common Law Partner Sponsorship

This class of family sponsorship allows you to sponsor your spouse or common-law partner to the country. 

Requirements for the Sponsor

  • You must be at least 18 years old
  • You must be a Canadian citizen or a permanent resident of the country
  • You must be living in the country at the time of application processing
  • You must not have a criminal history or charge with any kind of offence
  • You must not have a removal order against you (if you are a permanent resident)
  • You must not have been a sponsored member of Canada within the last five years

Requirements for the Sponsored Person:

  • Sponsored individuals must be at least 16 years of age
  • Sponsored individuals must not have any blood relations with the sponsor or must not be closely related to them

Requirements for the nature of the relationship:

The sponsored member must prove the nature of their relationship with the sponsor, and they must qualify under any of the below-mentioned categories:

Spouse: Under this category, the sponsored member and the sponsor must be legally married. If you were married in Canada, you would have to show the Certificate of Marriage from the province or territory to prove that your marriage is valid. Canada also recognizes same-sex marriage, and any same-sex marriage performed within Canada is also eligible for Spousal Sponsorship. If you were married outside of Canada, it is mandatory that the law in that country recognizes your marriage, and it must be valid under Canadian federal law.

Common-law Partner: To apply for a common-law partner, you and your partner (the person being sponsored) must live together for at least a year.

Conjugal Partner: Same-sex couples or opposite-sex couples who are unable to apply for common-law partners or spouses because of some exceptional circumstances that are beyond their control can apply under conjugal partners. This can include immigration barriers, same-sex relationships or any legal restrictions limiting divorce. These couples must have a mutually dependent relationship for at least one year and should have the same level of dependency and commitment as common-law partners or legal spouses. You can prove this by showing joint bank accounts, emotional ties, intimacy, etc. 

Parents and Grandparents Family Class Sponsorship

Requirements for the Sponsor

The sponsor and the sponsored member must sign an agreement that states that the sponsor will be responsible for fulfilling all the basic financial needs of their relative if required. If you are sponsoring the person to Quebec, you must sign an “undertaking” to commit to it.

  • As a sponsor, you must also promise to fulfill the basic financial needs of the sponsored member or any other eligible relative for the period of 20 years starting from the day they become a permanent resident.
  • You must also meet the minimum income requirement for this program.

Requirement for the Sponsored Person

The person being sponsored must be the parent or grandparents of the sponsor.

Parent and Grandparent Super Visa Sponsorship

Requirement for the Sponsor

  • You must be a child or grandchild or the person being sponsored
  • You must sign a commitment to fulfill their basic financial needs
  • You must prove a minimum income threshold to be a sponsor

Requirements for the Sponsored Person:

  • The sponsored relative must be a parent or grandparent of the sponsor
  • The sponsored person must be admissible to Canada 
  • The sponsored member must have medical insurance coverage for at least a year
  • The sponsored member must be willing to go through an Immigration Medical Examination

Dependent Child Sponsorship

Requirements for the Sponsor:

  • You must be at least 18 years old
  • You must be a Canadian citizen or a permanent resident of the country
  • You must be living in the country at the time of application processing
  • You must not have a criminal history or charge with any kind of offence
  • You must not have a removal order against you (if you are a permanent resident)
  • You must not be bankrupt

Requirements for the Sponsored Person:

One of the below-mentioned situations should apply to the person being sponsored: 

  • The dependent child should be less than 22 years of age
  • If they are 22 years of age or older and they are getting financial support from their parents before they are 22 because of a physical or mental condition

Requirements for the nature of the relationship:

You must be a biological parent of the child, or you or your spouse or common-law partner should be the legal parents of the child if they are adopted.
